Análisis de pertinencia de la recusación formulada en contra de la Procuradora General de la Nación.
El peticionario consideró que la Procuradora General debió declararse impedida en el presente caso, así como lo hizo respecto de las diferentes demandas de inconstitucionalidad admitidas por la Corte Constitucional sobre la prisión perpetua, pues impulsó y participó en la expedición de la ley cuando se desempeñaba como Ministra de Justicia.
La Sala Plena consideró que la recusación presentada en esta oportunidad no es procedente, debido a que no satisface los requisitos de oportunidad y carga argumentativa, al haber sido presentado de manera extemporánea y sin expresar de forma expresa la causal o causales de procedencia que invoca para sustentar la recusación, de acuerdo a los artículos 25 y 26 del Decreto 2067 de 1991.
